BitData agrees to provide internet-based and mobile internet-related services (“Network Services”) in accordance with the terms of this agreement and operational rules it may periodically publish. To obtain Network Services, users (“Users”) agree to all terms of this agreement and complete all registration procedures as prompted on the website. By clicking the “Agree” button during the registration process, users fully accept all terms under this agreement.
Service Content
2.1 BitData will provide specific Network Services based on actual conditions, such as publishing news comments and viewing market data.
2.2 Users understand that BitData only provides internet information services related to the blockchain industry platform. Users are responsible for their own devices (e.g., personal computers, mobile phones, and other devices related to internet or mobile network access) and associated expenses (e.g., telephone charges and internet fees).
Service Changes, Interruptions, or Termination
3.1 Due to the special nature of Network Services, Users agree that BitData has the right to change, interrupt, or terminate part or all of the Network Services at any time. BitData is not obligated to notify Users or assume any responsibility toward Users or any third party.
3.2 Users understand that BitData may regularly or irregularly conduct maintenance on the platform or related equipment that provides Network Services. BitData is not responsible for any interruptions in Network Services due to such maintenance within a reasonable time.
3.3 BitData has the right to interrupt or terminate provision of Network Services to Users under this agreement without any liability to Users or any third party in the following circumstances:
3.3.1 User-provided personal information is untrue;
3.3.2 User violates usage rules specified in this agreement;
3.4 If a BitData account registered by a User remains unused for a continuous 90-day period, BitData has the right to delete the account and cease providing related services to that User.
Usage Rules
4.1 When applying for BitData Network Services, Users must provide accurate personal information and promptly update any changes.
4.2 Users should not transfer or lend their account and password to others. If Users discover their account has been illegally used by others, they must notify BitData immediately. BitData is not responsible for any liability arising from hacking or User negligence.
4.3 Regarding any content Users upload to areas of the BitData website that are publicly accessible through Network Services (including but not limited to news comments, BitData micro-communities), Users grant BitData a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, and fully sublicensable right to use, copy, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such content (in whole or in part), and/or incorporate such content into any form, media, or technology now known or developed in the future.
4.4 Users must adhere to the following principles when using BitData Network Services:
4.4.1 Comply with laws and regulations;
4.4.2 Follow all network protocols, regulations, and procedures related to Network Services;
4.4.3 Not use the network service system for any illegal purposes;
4.4.4 Not infringe upon BitData's interests in any form using Network Services, including but not limited to unauthorized commercial advertisements;
4.4.5 Not engage in any behavior via BitData Network Services that may adversely affect the normal operation of the internet or mobile networks;
4.4.6 Not upload, display, or distribute any false, harassing, defamatory, abusive, threatening, vulgar, obscene, or other illegal information or materials using BitData's Network Services;
4.4.7 Not infringe upon any third party's patents, copyrights, trademarks, reputation rights, or any other legitimate rights;
4.4.8 Not engage in any behavior through BitData Network Services that is detrimental to BitData.
4.5 BitData reserves the right to review and supervise Users' use of BitData Network Services (including but not limited to auditing content stored by Users on BitData). If Users violate any of the above rules while using Network Services, BitData or its authorized persons have the right to request Users to correct such violations or take necessary measures (including but not limited to modifying or deleting posted content, suspending or terminating Users' rights to use Network Services) to mitigate the impact of Users' improper behavior.
4.6 Any statements, notifications, warnings, etc., made by BitData through various means (including but not limited to webpage announcements, emails, SMS reminders) regarding specific BitData Network Services are considered part of this agreement. Users who use such BitData Network Services are deemed to agree to the content of such statements, notifications, and warnings.
Intellectual Property Rights
5.1 Any text, images, graphics, audio and/or video materials included in BitData's Network Services are protected by copyright, trademark, and/or other intellectual property laws. Without the consent of the relevant rights holders, such materials may not be directly or indirectly published, broadcasted, rewritten, redistributed for broadcasting or publishing purposes, or used for any other commercial purposes. All such materials or any part thereof may only be stored on a computer for private and non-commercial use. BitData is not responsible to Users or any third party for damages, in any form, arising from delays, inaccuracies, errors, omissions occurring in the transmission or submission of all or part of such materials, or arising from such materials.
5.2 All rights to any software used by BitData for providing Network Services (including but not limited to any images, photos, animations, videos, recordings, music, text, and accompanying materials) belong to the copyright holders of such software. Without permission from the copyright holders of such software, Users may not engage in reverse engineering, decompiling, or disassembling of such software.
Privacy Protection
6.1 Protecting user privacy is a fundamental policy of BitData. BitData ensures that it will not publicly disclose or provide to third parties the registration information of individual users or non-public content stored by users when using BitData's network services, except in the following cases:
6.1.1 With the explicit authorization of the user in advance;
6.1.2 As required by relevant laws and regulations;
6.1.3 According to the requirements of relevant government authorities;
6.1.4 To safeguard the public interest;
6.1.5 To safeguard the legitimate rights and interests of BitData.
6.2 BitData may cooperate with third parties to provide relevant network services to users. In this case, if the third party agrees to assume the same responsibility as BitData to protect user privacy, BitData has the right to provide the user's registration information to the third party.
